An application under article 51A of the constitution of India on behalf of my father Gulabdhar Maurya Son of late Amarnath Maurya resident of village and post Lohiya Talab district Mirzapur to make enquiry regarding the compliance of the endorsement order passed by the Honourable sub divisional magistrate Sadar Mirzapur 28 September 2021. This order was addressed to the station house officer Kotwali Katra district Mirzapur quite obvious from the second page of the attached documents.It is quite obvious that one year and two months passed but no action was taken by the concerned to free the land of the applicant from the clutches of land mafia.The disposal of the following grievance has been done by the Lekhpal concerned through indiscriminate report through an absurd suggestion of seeking justice under section 116 of revenue code 2006 in the matter of Land grabbing which must be strictly dealt with by the police. The root cause of corruption is the arbitrary dealings of the bureaucracy which must be curbed otherwise there will be manifold increase in the corruption. What a bad precedent is being setup instead of punishing the land grabbers, the victim is being misled in the wrong way. Grievance Status for registration number : PMOPG/E/2023/0005044 Grievance Concerns To Name Of Complainant Anil Kumar Maurya Date of Receipt 05/01/2023It is clear from the report of Lekhpal concerned that both the father of the applicant and the opposite party have purchased the land from the same account number, but the entire land has been occupied by the opposite party, that means the share of the applicant land has also been occupied.  It has been clarified by the applicant that the demarcation of the part of the applicant side has been done by Tehsil Sadar under Section 24 Revenue Code 2006.  But the opposition refused to accept that demarcation.  Sir, everyone knows what is the working style of police and tehsil, now the applicant can fulfill their demands only up to his status.  Sir, the opposition parties are encroaching on the land, they can pay the asking price, but the applicant is not in this condition. The Yogi government talks about taking action against the land mafia but it is not doing it.  Sir, is Lekhpal a legal practitioner who is giving wrong advice.  The opposition is clearly in possession of the land, tell me how the Divisional Magistrate will get the possession removed from them, is the possession of the land wrongly removed under section 116 of the revenue 2006?  It is clear from the report of the Lekhpal that the opposition is in possession of the entire land and they are not ready to leave the land, but here the Lekhpal is running away from telling why he is not leaving because it will reveal the truth.

श्रीमान जी लेखपाल महोदय की रिपोर्ट से स्पष्ट है कि कि प्रार्थी के पिता और विपक्षी गण दोनों ने उसी खाता संख्या से भूमि क्रय किया है किंतु विपक्षी द्वारा संपूर्ण भूमि पर कब्जा किया गया है अर्थात प्रार्थी के हिस्से की भी जमीन कब्जा कर लिया गया। श्रीमान जी प्रार्थी द्वारा यही स्पष्ट किया जा चुका है कि प्रार्थी के रूम के हिस्से का सीमांकन तहसील सदर द्वारा धारा 24 राजस्व संहिता 2006 के अंतर्गत किया जा चुका है। किंतु विपक्षी ने उस सीमांकन को मानने से इनकार कर दिया। श्रीमान जी सभी जानते हैं कि पुलिस और तहसील की कार्य शैली क्या है अब प्रार्थी तो अपने औकात तक ही उनकी मांगों को पूरा कर सकता है ‌। श्रीमान जी विपक्षी गण तो जमीन कब्जा कर रहे हैं वह मुंह मांगी कीमत दे सकते हैं किंतु प्रार्थी तो इस स्थिति में नहीं है । श्रीमान जी योगी सरकार भूमाफिया के विरुद्ध कार्यवाही करने की बात करती है किंतु कर तो नहीं रही है। श्रीमान जी क्या लेखपाल महोदय विधि वेता हैं जो गलत ढंग से सलाह दे रहे हैं। विपक्षी स्पष्ट रूप से जमीन का कब्जा किए हुए हैं बताइए  उपजिलाधिकारी महोदय उनसे किस तरह से कब्जा हटवाएंगे क्या 116 के तहत गलत ढंग से जमीन का कब्जा हटाया जाता है। लेखपाल महोदय के रिपोर्ट से स्पष्ट है की विपक्षी पूरे जमीन पर कब्जा है और वह जमीन छोड़ने के लिए तैयार नहीं है किंतु यहां पर लेखपाल महोदय यह बताने  से भाग रहे हैं कि वह क्यों नहीं छोड़ रहे है क्यों

It is quite obvious that the opposite party has grabbed the entire land and is not interested to leave the grabbed land. Here the applicant is not the co-shareholder of the land but paid the price of the land and title has been decided by the concerned magistrate during the process mutation. Therefore, the applicant is the undisputed landlord and boundary of the land has been decided by the Tehsil and police, but possession could not be provided because opposite party members are notorious criminals as mentioned by the applicant in his earlier applications. Both police and Tehsil are frightened of them. The boundary of the land after mutation has been decided and Lekhpal itself accepted it his report that opposite has grabbed the entire land while in accordance with the law, they must claim for the piece of land purchased by them not the entire land consequently opposite party is reaping the benefit of muscle power and peace-loving nature of the applicant in the matter.
