विषय-An application under article 51A of the constitution of India to make enquiry regarding the latest development in the working of the administrative machinery and increase of the GST tax from 12 percent to 18 percent ipso facto. The matter concerns the excess payment of GST by the contractors but government is not providing this GST to them. Honourable madam, with due respect your applicant wants to draw the kind attention of you Honourable lady to the following points of the wide public interest.
1-It is submitted before the Honourable madam that this matter is specific to those tenders issued by the department from the year 2020 to 2022 and yet to complete them.
2-It is submitted before the Honourable madam that there is increase of 6 GST tax. For example if a contractor gets 5 lakh rupees payment from the government as contract made by them with the government. As per rate of GST earlier set by the Government contractor had to pay only 60000 rupees as GST tax.
But according to new levy imposed by the government on the taxpayers the rate of GST is now 18 which means according to new rate contractor has to pay 90000 rupees. This implies that contractor has to face 30000 loss.
3-It is submitted before the Honourable madam in the wide public interest the applicant wants to make inquiry to you that whether you have taken this matter with the senior rank officers of the department in the interest of poor contractors who are facing loss without any fault of them.
4-It is submitted before the Honourable madam that if the appropriate steps will not be taken on the part of you then 6 loss will occur to each contractor whose tenders were is issued during the aforementioned period.
5-It is submitted before the Honourable madam that The applicant is a human rights activist whose obligatory duty is to stop the violations of human rights of any individual. Whether government is not violating the human rights of the contractors?
I expect that you will adopt humanitarian approach to sort out the problems of the poor contractors who are in the state of dilemma.
Please inform the applicant if any positive approach taken by you in this regard which may safeguard the rights of the poor contractors.
