* Prayer or Relief SoughtSir, information sought by appellant is concerning compensation in burning of crops which details are as follows. Sir, the date of the office memo of Uttar Pradesh Power Corporation Limited is 25 September 2021 while the date of crop burning is 18 April 2021 and the report submitted by Lekhpal is dated 15 June 2021 which has been forwarded by Kanungo on 19 June 2021 i.e. Sir, The circular being referred to is of a later date. Sir, on the basis of the above memo, the executive engineer, Electricity Distribution Division II, Mr. AK Singh, withholding the compensation of applicant Dayanand Singh, does not show arbitrary, illegal, unconstitutional and dictatorial tendency, As well as his information is based on this memo which is misleading and not consisted to points of information. Office memo date is 25 Sept 2021, crops burning date is 18 April 2021, report submitted by Tehsil is 19 June 2021, how memo can be applied on report? Here this question arises: how can office memos aforementioned be applied retrospectively to deprive farmers of compensation for those whose crops were burnt due to short-circuit during Covid epidemic? There are no explicit guidelines in the aforementioned office memo to apply it retrospectively but it is being applied retrospectively which is illegal and arbitrary action on the part of the Uttar Pradesh power corporation limited. Circular letter number-2828 dated -25 September 2021 office memo of U.P.P.C.L. deprived farmers of compensation whose crops burnt in covid epidemic. How can the Yogi government do such injustice with the farmers because such action is maintainable because of the rampant corruption in the working of the Uttar Pradesh Power corporation limited? How could the Executive Engineer Electricity distribution division second do retrospection of the aforementioned office memo? This office memo was applied to curb the compensation of farmers whose crops were burnt due to short circuits during the Covid period. Sir, if there was honesty in the Mirzapur office of Uttar Pradesh Power Corporation Limited today, then such an arbitrary answer which has nothing to do with the points of complaint would never have been imposed by the Executive Engineer Electricity Distribution Division II. * Description of Information SoughtAn application under Article 51A of the constitution of India on behalf of Dayanand Singh son of Sobhnath Singh village Nibi Gaharwar post Nibi Gaharwar district Mirzapur. The compensation is pending before the local office of the Uttar Pradesh Power Corporation Limited by taking the recourse of three points.1-Engineer EDD II Mirzapur seeking copy of the F.I.R. registered in the matter.2-Recommendation made by Tehsil Sadar did not contain the initial of the Tehsil Sadar.3-Copy of the Bank passbook of the victim of electrical accident Dayanand Singh son of Late Shobh Nath Singh, Village-Nibi Gaharwar, Post-Nibi Gaharwar, Tehsil-Sadar, District-Mirzapur, PIN Code-231303. Sir, in the case presented by you, action is required on the report submitted by Tehsil Sadar, if there is any error in the report, then that error can be resolved by the responsible officers and employees of Tehsil Sadar itself. Addressing Dayanand Singh S/o Somnath Singh that you remove error, how can it be justified? Sir, there is no role of Dayanand Singh son of Shobhnath Singh here, whatever role is there, it belongs to Lekhpal Kanungo and Tehsildar of Tehsil Sadar and the report is also by him only, therefore the principle of natural justice says that the Executive Engineer Electricity Distribution Section II Get the errors resolved by contacting Tehsil Sadar and pay the compensation to the applicant as soon as possible. PIO of UPPCL may provide the following information to the information seeker point wise as follows.
1-Provide the mechanism to seek compensation in the aforementioned matter.
2-Who should submit the copy of F.I.R. in the matter as recommendation done by Tehsil Sadar and entire formalities done by them in order to provide damages.
3-Provide the mechanism to take action on the recommendation if made department of revenue of the government of Uttar Pradesh in case of burning of crops due to electrical accidents.
4-Provide the circular which justify the stand of executive engineer EDD II Mr. A. K. Singh to sort out lacunae in the report of Tehsildar Sadar expected from the victim Dayanand Singh while it was required to exchange communication from the Tehsil Sadar.
5-Provide feedback for making F.I.R. mandatory to provide compensation in damages of crops due to fire originated from electrical accidents as it was purely civil procedure and police acts in accordance with criminal procedure code. Whether it is not reflecting the negative attitude of the Uttar Pradesh Power corporation limited in providing compensation to victims of electrical accidents.
