FAA took falsely recourse of memorandum of dept. of personnel applicable to CPIOs not state governments and union terrioteries

According to subsection 4 of section 3 of the aforementioned office memorandum

(iv) If a person makes an application to a public authority for some information which is the concern of a public authority under any State Government or the Union Territory Administration, the Central Public Information Officer (CPIO) of the public authority receiving the application should inform the applicant that the information may be had from the concerned State Government UT Administration. Application, in such a case, need not be transferred to the State Government UT Administration.

   Following is the Hindi translation of the manipulated office memorandum provided by the First Appellate Authority who tried to mislead the information seeker by substituting CPIO by PIO and unnecessarily including Uttar Pradesh. 

It is quite obvious that office memorandum of the ministry of personnel and training is for the CPIOs of the central government but it is reflecting insolence of the incompetent of the First Appellate Authority who made failed attempt to mislead the information seeker. 

Please refer to DOPT OM no. 10/2/2008-IR dated 12/06/2008, जिसमें यह स्पष्ट किया गया है कि यदि कोई व्यक्ति किसी राज्य सरकार या केंद्र शासित प्रदेश प्रशासन के तहत किसी सार्वजनिक प्राधिकरण से संबंधित किसी जानकारी के लिए किसी सार्वजनिक प्राधिकरण को आवेदन करता है, तो प्राप्त करने वाले लोक प्राधिकरण के केंद्रीय लोक सूचना अधिकारी (पीआईओ) आवेदन में आवेदक को सूचित किया जाना चाहिए कि सूचना संबंधित राज्य सरकार/संघ राज्य क्षेत्र प्रशासन से प्राप्त की जा सकती है। ऐसे मामले में आवेदन को राज्य सरकार/संघ राज्य क्षेत्र प्रशासन को स्थानांतरित करने की आवश्यकता नहीं है। इसके अलावा, पोर्टल के होम पेज पर दिए गए निर्देश स्पष्ट रूप से इंगित करते हैं। कृपया इस पोर्टल के माध्यम से सरकार सहित राज्य सरकारों के तहत सार्वजनिक प्राधिकरणों के लिए आरटीआई आवेदन दाखिल न करें। उत्तर प्रदेश की। यदि दायर किया जाता है, तो आवेदन राशि की वापसी के बिना, वापस कर दिया जाएगा। तदनुसार, आपका आरटीआई आवेदन, जो किसी भी राज्य सरकार के तहत एक सार्वजनिक प्राधिकरण की चिंता है, इसके साथ वापस किया जाता है। आप इसे राज्य सरकार के तहत संबंधित सार्वजनिक प्राधिकरण के समक्ष दायर कर सकते हैं।
