The matter concerns arbitrary action of District Magistrate Sultanpur as overlooked the objection made by the aggrieved family of additional district Judge Mr. Manoj Shukla and used JCB to dig the transitory land inherited from ancestors of the aggrieved family. 
A petition under Article 32 of the constitution of India to seek remedy in the matter concerned with the lawlessness and anarchy in the state of Uttar Pradesh because of the rampant corruption in the government machinery where representations of the people in the state are neglected arbitrarily and government adopt no logistic approach to fix the accountability of the administrative officers in the state of Uttar Pradesh.

Prayer-Think about the gravity of the situation that to acquire justice a frustrated judicial member under extreme trauma having no legitimate option except to take law in its own hand. 
This implies that temple justice is no longer the last option for frustrated people in the state of Uttar Pradesh. Whether provisions of the constitution are safe in this largest populous state of this largest democracy in the world?
With due respect, the applicant invites the kind attention of the Honourable Sir to the following submissions as follows.
1-1-I pray before the Honourable Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;

(i) to safeguard public property and to abjure violence;

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.
2-I pray before the Honourable Sir that please take a glance of the following news update which shows that a senior rank judicial member being disturbed with the tyranny and arbitrariness of District Magistrate compelled to take law in its own hand to defy the illegal stand of the district magistrate.

उत्तर प्रदेश के बस्ती का मामला जेसीबी के सामने लेटे न्यायिक अधिकारी 
उत्तर प्रदेश के बस्ती में अपनी जमीन के लिए अपर जिला जज (एडीजे) को जेसीबी के सामने लेटा पड़ा. इसका वीडियो वायरल हो रहा है. समाजवादी पार्टी (सपा) के राष्ट्रीय अध्यक्ष अखिलेश यादव ने तस्वीर शेयर करते हुए कहा कि जब न्यायालय से जुड़े व्यक्तियों के साथ ऐसा हो रहा है तो आम जनता के साथ क्या होगा. जनता
के साथ क्या होगा. जनता को जस्टिस चाहिए जेसीबी नहीं!


दरअसल, बस्ती जिले के हरैया थाना क्षेत्र के छपिया शुक्ल गांव में नहर खुदाई के दौरान जेसीबी के सामने न्यायिक अधिकारी मनोज शुक्ला का हाई बोल्टेज ड्रामा सामने आया. न्यायिक अधिकार नहर खुदाई कर रही जेसीबी के आगे लेट गए. घंटों तक ड्रामा चलता रहा.
 न्यायिक अधिकारी वर्तमान में जिला सुल्तानपुर में एडीजे फर्स्ट के पद पर तैनात हैं.

न्यायिक अधिकारी मनोज शुक्ला पूरी रात जिला प्रशासन की टीम के सामनेबिना खाये-पिये पड़े रहे. जिला प्रशासन की मिन्नत के बाद भी न्यायिक अधिकारी नहीं पसीजे और अपने जिद पर अड़े रहे. इस नहर के हुए निर्माण को एडीजे के भतीजे
द्वारा गिराया गया था और जिले के जिलेदार द्वारा तहरीर पर एक एफआईआर भी दर्ज की गई थी.

एडीजे मनोज शुक्ला ने बताया, 'मैं एक न्यायिक अधिकारी हूं, ये मेरी पुश्तैनी जमीन है जहां पर सब लोगों द्वारा हमारी जमीन पर कब्जा किया जा रहा है, ये काम गलत है, 2013 में जमीन का अधिग्रहण नियमों के विपरीत हुआ है डीएम ने जो आदेश दिया है वो भ्रष्टाचार से युक्त आदेश है. 
3-It is submitted before the Honourable Sir that whether the logistic approach adopted by the District Magistrate to find out an amicable solution in the matter instead of applying his administrative power to dig the ancestral land illegally encroached by administration through arbitrary action as objection made by the aggrieved family. Undoubtedly the district magistrate has no regard for the rule of law ipso facto as his arbitrary action irritated the senior rank judicial member.

             इस मेरे प्यारे देश को क्या हुआ सोचता होगा||

This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.
