* Prayer or Relief Sought Appellant sought information by submitting online application Registration Number SSPPY/R/2021/60099 Name Yogi M P Singh Date of Filing 05/10/2021and sought four point information from the public information officer in the office of senior superintendent of police District-Prayagraj which was denied by him/her arbitrarily. The matter concerns the blatant misuse of power and position by the police in regard to scheduled caste and scheduled tribe acts because of corruption.Since the government is providing grants to the people under this act so there is possibility to register false cases under this act by colluding with police because of corruption in the department. Appellant sought four point information from Circle Officer Soraon District-Prayagraj but not a single point of information was made available by the Circle Officer Soraon Prayagraj. Undoubtedly, Circle Officer Soraon Prayagraj made the mockery of the RTI Act 2005 therefore disciplinary proceedings must be initiated against him/her and must be directed to provide information as sought by the appellant. To provide information to the information seekers is the obligatory duty of the public information officer and his/her accountability is fixed under chapter 20 of the Right to Information Act 2005 by state information commission. Here information has been denied by the station officer Mauaima through registered communication unfortunately not containing the covering letter of Circle Officer Soraon Prayagraj. According to point IX of subsection 1 c of section 4 of the Right to Information Act 2005, It shall be obligatory duty of every public authority to publish within one hundred and twenty days from the enactment of this Act, publish all relevant facts while formulating important policies or announcing the decisions which affect the public. It is most unfortunate that circle officer, Soraon, District-Prayagraj did not provide feedback available in the police station Mauaima regarding misuse of ambitious scheduled caste and scheduled tribe act of the government ipso facto from cryptic denial of Information by the Station Officer Mauaima. More than 15 years passed but police of District Prayagraj ran away from providing information concerning the working of police personnel posted in the Mauaima police station district Prayagraj. Under Section 6 of the RTI Act, an applicant is entitled to get information which can be accessed by the “public authority” under any other law for the time being in force. Here concerned public functionaries are behaving like tyrants and keeping themselves above the law by superseding rule of law.
