For the enquiry by a technical expert, chauki in-charge Bali Maurya forwarded the matter to the executive officer municipality Mirzapur city and a thorough enquiry was carried out by the engineer municipality Mirzapur city and enquiry report dated-31/08/2021 letter number-194 was submitted before executive officer, municipality Mirzapur city. According to report of sub inspector Umesh Ray dated-07-09-2021 attached as page 2 of the attached PDF document to this representation, police will act on the report of Executive Engineer municipality Mirzapur city not on the report of city Engineer of the Municipality Mirzapur city. Report of the Executive Engineer municipality Mirzapur city dated-09-09-2021 is attached to the representation as page 1 of the attached PDF document to this representation as well as this report received by the office of the office of the chauki in charge and office of Kotwal, Kotwali Katra District-Mirzapur. Circle officer City, Prabhat Ray had promised in its office located in police line to take action in the matter after the report of Executive Engineer municipality Mirzapur city when applicant met him in regard to matter on 07 Aug 2021 afternoon aongwith social worker Yogi M. P. Singh. * Prayer or Relief Sought Registration Number- SPMZR/R/2021/60029 Name- Sudarshan Maurya Date of Filing- 03-08-2021 Detail is attached to the appeal in the PDF form. According to subsection 1 of section 7 of the Right to Information Act 2005-Subject to the proviso to subsection (2) of section 5 or the proviso to subsection (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9:It is 16 Sept 2021 today which means 1 month 14 days passed, but PIO did not provide any information which means PIO denied information as quite obvious from the subsection 2 of section 7 of the Right to Information Act 2005 If the Central Public Information Officer or State Public Information Officer, as the case may be, fails to give decision on the request for information within the period specified under subsection (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall be deemed to have refused the request. Consequently, PIO violated subsection 1 of section 7 of the Right to Information Act 2005. Circular dated 09 Sept 2021 to curb misuse of section 107/116/151 in the sequence of the directives High court of judicature at Allahabad is the first page of the attached document. Undoubtedly sought information was denied by the public information officer in the office of superintendent of police Mirzapur because supervisory bodies are in good faith of the subordinates quite obvious from the circular issued by the government and worries of the high court regarding misuse of provisions of Cr. P.C. by the police personnel.

* Description of Information Sought To create undue pressure on the applicant, chauki in-charge Mandi samiti fabricated charges under criminal penal code 107/116 quite obvious from the third page of the attached document. It is most surprising that whenever anyone seeks justice in the department of police then from that person there is apprehension of breach of peace in the society and police imposes on them section of criminal panel code 107/116.This implies that to register FIR in the department of police, one May be ready to get registered a case under Cr.P.C. 107 /116 on itself.
1-Please provide the reason as required under subsection 1 d of section 4 of the Right to Information Act 2005 to fabricate information seeker under Cr.P.C. 107 /116. Please take a glance of first page of attached PDF which is report submitted by the chauki in-charge Mandi samiti in the following complaint on the Jansunwai portal. 2-Please provide the reason, if Yakoob Ansari is not interested to take back the articles used for construction of houses, then why, concerned police did not take articles in its own custody as requested.
3-Please provide the progress report in the matter as chauki in charge requested city magistrate to appoint technical expert to ascertain the loss occurred to information seeker because dereliction of accused contractor.
