* Description of Information Sought The applicant has submitted a petition under section 32 and section 38 of the revenue code 2006 when the office of tehsildar Lalganj requested the requisite documents from the applicant to carry out the processing of inheritance. Now they have changed their stand as usual. Most respected sir please take a glance at the first page of the attached pdf document based on the site inspection of the staff of Tehsil Lalganj dated 5th August 2024.
Under section 32 revenue inspector may submit his report before the sub divisional magistrate Lalganj and sub divisional magistrate Lalganj may order under section 38 of the revenue code 2006 and provide justice to the vulnerable applicant.
It is quite of yes that matter concerns forgery by taking under good faith the concerned staff of the tehsil Lalganj to usurp the property of the applicant illegally.
According to U.P. revenue Code section 32- Where during the course of inquiry under rule 30, the Revenue Inspector finds that the claim regarding succession is disputed or where such claim is based on any will, then after ascertaining the nature of such dispute or the facts relating to the execution of such will, the Revenue Inspector shall submit his report.
Section 38 of the Uttar Pradesh Revenue Code of 2006 allows for the correction of errors or omissions in revenue records. However, this section does not allow for the resolution of disputes involving questions of title.
Public information officer in tehsil Lalganj must provide the following information to the information seeker point wise as follows.
1- Right to reason is an indispensable part of the sound administrative system quoted by the Supreme Court of India on a number of occasions. Tahsildar Lal Ganj must provide the reason for seeking documents to process the inheritance under section 32 of the revenue code 2006.
2- Most respected Sir please take a glance of the second and third page of the attached pdf document to the online rti application through which Tehsildar Lalganj denied to process inheritance. Please provide the reason for changing the stand and misleading the monitoring bodies on the Jansunwai portal and applicant with his changed stand.
3- These contrary reports lowered the dignity of the public grievance portal and Jansunwai Portal of the government. Please provide the action taken against the Tehsildar Lalganj by the competent authority of the government.
4- It is quite obvious that earlier processing of inheritance was illegal because the name of the applicant was deliberately not included in the processing by reaping the vulnerability of the applicant. The staff of Tehsil Lalganj also colluded with them. This implies that there is no title dispute between the opponents and the information seeker. Please provide the reason for not ordering an inquiry in this matter of corruption in processing the inheritance by the staff of Tehsil Lalganj.
Public Information Officer, Tehsil Lalganj must provide the four points of information within 30 days From the date of receipt of the application in the office of Public Authority as prescribed under subsection 1 of section 7 of the right to information act 2005.
