The objection submitted by the applicant is missing from the paper book and sub divisional magistrate sadar passed order in favour of the opposite party by taking recourse that applicant did not submit the objection instead of ordering search of missing document of court to police. This implies that sub divisional is itself a party of conspiracy to manage the court document missing which is a criminal offence. The report of Tehsil sadar attached as first page to the attached PDF document is an illogical conclusion of a Lekhpal who is the lower most rank staff of Tehsil sadar. Whether corruption of a key post can be shielded arbitrarily as being done?
Sir, the above complaint was investigated by Sub-Inspector Vijendra Giri mobile number 94513 98018. Their investigation report is the second page in the enclosures attached with this complaint. The summary of their investigation is as follows. It is to be informed with respect that the aforementioned application of the above-mentioned applicant was examined by me, the sub-inspector, it was found that the applicant mentioned above, and the opposite party are real nephews and uncles. A suit for partition was filed by the opposite party under section 116 of the Land Revenue Code before the Honourable Sub-divisional Magistrate, Mirzapur, in which objection was filed by the applicant. The applicant alleges that without taking cognizance of his objection, an ex-parte order has been passed in favour of the opposition party. The applicant being aggrieved has given the complaint applications. The application of the applicant is not related to the police department but to Tehsil Sadar Mirzapur and it is a humble request to honourable sir that please get the application investigated from the concerned.
श्रीमान जी प्रकरण का संबंध न्यायिक कार्य करते हुए भ्रष्टाचार से संबंधित है जिसमें उप जिलाधिकारी सदर द्वारा जानबूझकर पत्रावली गायब करा कर के एक पक्षी फैसला दिया गया है। इसलिए उप जिलाधिकारी सदर के ऊपर भ्रष्टाचार का मामला पूर्ण रूप से प्रमाणित है। श्रीमान जी प्रकरण का उच्च स्तरीय जांच कराया जाए और भ्रष्टाचार के इस प्रकरण में नियमानुसार कार्यवाही की जाए। श्रीमान जी प्रकरण को कभी उप निरीक्षक के पास जांच के लिए भेजा जाता है तो कभी लेखपाल के पास जांच के लिए भेजा जाता है वह सभी उपजिलाधिकारी सदर से भयभीत रहते हैं तो वे जांच क्या करेंगे और नियमानुसार कार्यवाही क्या करेंगे। यदि ईमानदारी से कार्य करना है तो मामले में सर्वप्रथम प्रथम सूचना रिपोर्ट दर्ज की जाए उसके उपरांत विवेचना की जाए। जिससे जवाबदेही तय हो सके।
Sir, the case is related to corruption while doing judicial work, in which a one-sided decision has been given by the Deputy District Magistrate/ Sub divisional magistrate Sadar by intentionally making the letter disappear. That is why the case of corruption against the Deputy District Magistrate/Sub divisional magistrate Sadar is completely proved. Sir, a high-level inquiry should be conducted into the matter and action should be taken as per rules in this matter of corruption. Sir, the case is sometimes sent to the sub-inspector for investigation and sometimes it is sent to Lekhpal for investigation, all of them are afraid of the sub-district magistrate / Sub divisional magistrate Sadar, so what will they investigate and what action will be taken according to the rules? If the work is to be done honestly, first of all the First Information Report should be registered in the matter and only then it should be investigated. So that accountability

महोदय उपनिरीक्षक बिजेंद्र गिरी जिनका मोबाइल नंबर 9451358018 है उनका यह कहना किसी ढंग से उचित नहीं है कि प्रार्थी द्वारा वाद में आपत्ति दायर किया गया और उसको उप जिलाधिकारी महोदय द्वारा संज्ञान नहीं लिया गया क्योंकि यह तो उनका कार्यक्षेत्र है ऐसी जबरदस्ती तो उनके लिए आम बात है वह किसी भी आपत्ति को सुने या ना सुने यह उनका कोर्ट है किंतु यहां महत्वपूर्ण तथ्य है कि प्रार्थी द्वारा प्रस्तुत किया गया आपत्ति उप जिलाधिकारी महोदय ने अपने पेशकार के माध्यम से गायब करा दिया यह तथ्य महत्वपूर्ण है जो कि भारतीय दंड संहिता में अपराध की कोटि में आता है और यह कृत्य करके उप जिलाधिकारी महोदय ने अपने ही न्यायालय की अवमानना किया है जो कि गंभीर अपराध की कोटि में आता है और किसी भी तरह से शमनीय नहीं है ऐसे में उप जिलाधिकारी महोदय के विरुद्ध कार्यवाही ना करना राज्य सरकार की कायरता को दर्शाता है यदि उप जिलाधिकारी महोदय अपने अर्ध न्यायिक कार्य का संपादन करते समय खुद ही न्यायालय की अवमानना करके अपराधिक कृत्य करते हैं तो उनको दंडित होना चाहिए किंतु ऐसा हो नहीं रहा है जो की भ्र्ष्टाचार परिलक्षित करता है
