आवेदक का नाम-Yogi M P Singhविषय-शिकायत संख्या -40019922028514 आवेदक का नाम-Yogi M P Singh the aforementioned application submitted by the applicant for the payment of the honorarium of the month of January 2022 of the lab technicians working under the monitoring of the chief medical officer Mirzapur. The date of the application is 23rd December 2022 and disposed of by the labour enforcement officer Mr Kaushlendra Kumar Singh on 24th December 2022 by considering it as a suggestion category. Honourable Sir may be pleased to take the perusal of the first page of the attached document to the grievance which is the attached report of the labour enforcement officer submitted by him on the Jansunwai portal of the Government of Uttar Pradesh. Whether the mechanism available on the Jansunwai portal is only available for the people of this state of Uttar Pradesh to get the suggestion from the labour enforcement officer to file the plant before the appropriate court. Already two communications have been sent by the assistant labour commissioner to the chief medical officer Mirzapur and he did not pay heed to the letters of the assistant labour commissioner Mirzapur. Whether it is not reflecting the incompetency at the assistant labour commissioner who does not know how to enforce the compliance of its request. What is the function of the labour department if any application is submitted for the non-payment of the dues by the employer, then aggrieved may be suggested that he may file a plaint to get the payment of dues and these plaints languish for many years before the appropriate court quite obvious from the scenario of the country. Whether the chief medical officer is frightened with his act of offences committed by him against the provisions of this country made by the rule making bodies. Here this question raises why a labour enforcement officer is trying to make an attempt to complicate the matter by his absurd suggestions instead of convening the concerned parties on a negotiable table. Chief medical officer is not paying honorarium of January of Lab Technicians on flimsy ground despite interference of assistant labour commissioner. It is quite obvious from the attached documents to the complaint. Two communications were sent by the office of assistant labour commissioner, but it is most unfortunate that chief medical officer district Mirzapur took these two directions under teeth which is a mockery of the law of land. An application under Article 51A of the constitution of India to make enquiry regarding the non-payment of emoluments of salary of the lab technicians working on the contract basis as daily wage staff of the Hazrat Yusuf imam hospital Mirzapur. This is a humble request of the applicant to the chief medical officer and the CMS of the divisional hospital Mirzapur to take action in the matter to provide the salary of the month of January 2022. Sir, Chief Medical Officer Mirzapur, in his report dated 23 November 2022, informed that all the Lab Technicians for Covid-19 have been provided by the concerned firm Silicon Pvt Ltd Varanasi on contract under the outsourcing process on the instructions of the Government Directorate General. Whose honorarium i.e. The payment of the honorarium is done every month only after receiving the attendance certificate from the place of posting by the agency on submission of the bill in the undersigned office, according to the rules, attendance certificate has been received for the workers, whose payment of honorarium is being processed.
