Grievance Description

You redressed the following grievance of the applicant without adopting a logistic approach in the matter which reflects the insolence of the concerned staff quite obvious from the submitted arbitrary report attached to this grievance. This matter is not a land dispute, but cheating carried out by the seller of the land and police is adopting a reluctant approach in the criminal matter to be dealt under section 420 of I.P.C. quoted as follows.
Section 420 of The Indian Penal Code talks about the offence of cheating which is committed by the person who cheats another person and thereby induces the deceived to deliver any property. This provision provides punishment for the same.
Provisions regarding cheating have been defined in the Indian Penal code in chapter XVII, Section 415-420 of the code deal with the offence of cheating. Section 415 defines the term cheating while S.417, 418, and 419 provide for punishment for the offence. Ingredients As mentioned earlier, Cheating has been defined in section 415 of the code.
प्राप्त फीडबैक -दिनांक04-08-2022 को फीडबैक:-Honourable sir I am not satisfied with the resolution of the above complaint, the police did not do anything, neither did they come to our land nor did they help the applicant in getting our land from seller and entire time passed only by calling us. The police say that in regard to your land, will it be the job of the police to get the possession of? Honourable Sir, if the police will not solve this, then who will do it. Respected Sir, it is a humble request of the applicant to you, Honourable Sir to help us in getting our land from the opposition. If the seller is not interested in providing the possession of land to the purchaser, then he must return back the paid amount with compound interest and compensation as well.
Think about the discretion of circle officer Sadar, he provoked the concerned police to implicate the applicant under Cr.P.C. 107/116 which are preventive measures and High court of judicature at Allahabad has issued directions to curb the misuse of Sections 151/107/116 of Cr.P.C. and government issued circular to award pecuniary penalty of Rs.25000 on its misusers.

Sir, it is most regretting that process of mutation was completed on 09 September 2019 near about three years ago but the seller of the land-Pappu Singh Chauhan, Name of the Father-Shyam Bihari Village-Dhaurupur, Tappa-84 District-Mirzapur, Uttar Pradesh did not provide the possession of the land. Please take appropriate action in the matter so that ramification of lawlessness and anarchy may be curbed and applicants may get justice. For this applicant shall ever pray to you Honourable Sir.
