* Description of Information Sought Everyone knows that proceedings under Section 151/107/116. of the Cr. P.C. are only preventive measures and not pure criminal proceedings. These tools are used to maintain the peace and tranquillity in the society. A circular issued by the government of Uttar Pradesh to curb the abuse of Section 151/107/116. of the Cr. P.C. under the instructions of the High court of judicature at Allahabad on 09 Sept 2021 attached to this RTI request as the first page of the document. Government of Uttar Pradesh has directed those police personnel found guilty of misusing the Section 151/107/116. of the Cr. P.C. may be penalized with pecuniary penalty of Rs.25000. If there may be genuine invitation for the application of Section 151/107/116. of the Cr. P.C., then to prevent the breach of peace, these provisions of criminal penal codes may be applied.
PIO in the office of D.G.P. Uttar Pradesh may provide the following information to the information seeker within stipulated time as specified under subsection 1 of section 7 of the Right to Information Act 2005.
1-When the complaint is made before Kotwal, City Kotwali District-Mirzapur, then instead of taking any action in the matter to fix the issue, he fabricates the husband of the applicant under Section 107/116. of the Cr. P.C.. Consequently, my husband fabricated six times under Section 151/107/116. of the Cr. P.C. आवेदनकर्ता का विवरण शिकायत संख्या -40019922018952 आवेदक का नाम-Archana Dubey आवेदनकर्ता का विवरण शिकायत संख्या -40019922019135 आवेदक का नाम-Archana Dubey both these complaints submitted on Jansunwai portal of government by the information seeker closed by the report submitted by sub inspector Jay Prakash Sharma under the monitoring cum supervision of Kotwal of city Kotwali Mirzapur. They implicated the husband of the applicant again under Section 151/107/116. of the Cr. P.C. Thus, my husband has been implicated under Section 151/107/116. of the Cr. P.C. seven times. For the more details, vide attached document to the RTI request.
Please provide the maximum number of times to implicate the husband of the information seeker to implicate under Section 151/107/116. of the Cr. P.C. subsequently information seekers may expect a logistic approach in the matter.
2-Your applicant submitted representation before the Honourable Sir on 30 April 2022 against the offenders when they assaulted the applicant and her husband, and it is most regrettable that no action was taken by the concerned staff still even after more than three months.
Please provide action taken by the police on the aforementioned representation of the information seeker.
3-Provide the measures taken by the DGP office Lucknow to curb misuse of Section 151/107/116. of the Cr. P.C.,

ReplyDeleteMisuse of provisions of criminal procedure code is quite obvious in the working of the police in the state of Uttar Pradesh.Police in the state off Uttar Pradesh do not perform its duty without taking illegal gratification and everyone knows it but still police personnel are busy in showing off and boasting then it is their mistake.
