With due respect, your kind attention is kindly drwan towards following submissions as follows.
1-Victim purchased 38 Bags of Ultratech cement at the rate Rs.410 per bag from offender 1.
2-I pray before the honourable Sir that Victim purchased total building material of Rs. 148000 in word one lakh 48 thousand rupees and labour charge of family members excluded.
3-It is submitted before the Honourable Sir that entire cement provided by the offnder 1 was found spurious in the checking by the technical expert.
4-Since the offender 1 provided the spurious cement to victim so several cracks found in the ceiling of the rooms and roof is so weak that it may cause accident at any time to family members.
5-Victim is poor and making house provided by the government under prime minister scheme and this spurious cement caused huge loss to the victime. For more details, vide attached document to the grievance.
As per Section 420 of IPC, whoever cheats and thereby dishonestly induces the person deceived to deliver any property to any person, can be said to have committed the offence under Section 420 of IPC.Where a person cheats another by deceiving himself to be someone else, he is guilty under section 416 IPC and punished under section 419 IPC. Punishment under this section is a jail term which may extend to three year jail term along with fine.Provisions regarding cheating have been defined in the Indian Penal code in chapter XVII, Section 415-420 of the code deal with the offence of cheating. Section 415 defines the term cheating while S.417, 418, and 419 provide for punishment for the offence. As mentioned earlier, Cheating has been defined in section 415 of the code.A cheats Z. Section 24 defines what is “acting dishonestly”. When the doing of any act or not doing of any act causes wrongful gain of property to one person or a wrongful loss of property to a person, the said act is done dishonestly. The word property may basically be defined as all things which can be measured in terms of money.
