Kamlesh Singh submitted plea before U.P.H.R.C. to reconsider earlier passed order by the commission as matter also concerned to police

Honourable commission passed following order in the aforementioned cases. 

Proceeding प्रार्थी श्री योगी एम0पी0 सिंह द्वारा दिये गये शिकायती प्रार्थना पत्र में विजली चोरी से सम्बन्धित ब्योरा अंकित किया गया है जिसमें अधिशासी अभियन्ता द्वारा कार्यवाही की गयी है। पुनः इस प्रकरण मेें आयोग स्तर से किसी कार्यवाही की आवश्यकता वांछित प्रतीत नहीं होती है।

Action : Dismissed in Limini(Action No 1). For more detail, vide attached document to the petition. 

Please reconsider the aforementioned order passed by the commission as passed because of the failure of the petitioner to explain the matter before the Honourable commission. Here the executive engineer's report is auxiliary proving premises of Kamlesh Singh in which electricity connection was taken are grabbed by the accused.

Concerned matter is bipolar.

1-One of the poles is the theft of electricity resolved by the concerned executive engineer EDD II Manoj Kumar Yadav. Undoubtedly action taken against theft of electricity but premises are still under the possession of land grabbers who are using electricity connection of Victim Kamlesh Singh and premises of Kamlesh Singh. It is the job of police to free the premises of the electricity connection taken by the victim Kamlesh Singh from the clutches of grabbers. From the report of the executive engineer, it is obvious that premises of the electricity connection are in the possession of grabbers. 

2-Other pole is the grabbing of the premises by the accused who are shielded by the police concerned against whom petitions made by the complainant Yogi M. P. Singh.

Following complaint made by the victim against the accused overlooked by the police through arbitrary reports.

Section 441 (Criminal Trespass): When someone unlawfully enters a property, or lawfully enters a property but unlawfully remains there (such as a tenant after expiration of tenancy) with the intent to commit an offense, or to intimidate, insult or annoy the person in possession of such property, it amounts to criminal trespass. Section 503 (Criminal Intimidation): Any threat of injury to a person, reputation or property with the intent to cause them to do something which they are not legally bound to do is a form of “criminal intimidation”.
