1-Please restrain divisional forest officer, Gorakhpur for blatantly misusing his power and position to violate the constitutional and human rights of Satyendra Singh provides its services to the Baki range of the Gorakhpur division. Twenty-seven months remuneration has been withheld by the divisional forest officer according to aggrieved victim Satyendra Singh but regarding 19 months salary, DFO Gorakhpur is saying that whoever Area Forest Officer has taken services that must provide the service charge.
Most respectfully sheweth that
2- According to Article 4 of Universal Declaration of Human Rights-
No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.
Whether it is not inhuman treatment of the concerned divisional forest officer Gorakhpur with the victim who still not paid the charges of services half of the minimum wages decided by the government of Uttar Pradesh? Whether treatment like bonded labourers with the daily wage staff is justified in this largest democracy in the world?
3-Communication dated12 Oct 2020 of the Area Forest Officer Baki range Mr. Jagdamba Pathak is attached to this petition as page 3 of the attached document. To prepare this report, Divisional Forest Officer Gorakhpur blatantly misused his power and position.
4- According to Article 3 of Universal Declaration of Human Rights-Everyone has the right to life, liberty, and security of person.
Article 2 of the Human Rights Act protects your right to life.
This means that nobody, including the Government, can try to end your life. It also means the Government should take appropriate measures to safeguard life by making laws to protect you and, in some circumstances, by taking steps to protect you if your life is at risk.
Public authorities should also consider your right to life when making decisions that might put you in danger or that affect your life expectancy.
If 27 months salary will be withheld by the tyrant like Divisional Forest Officer Gorakhpur blatantly misusing his power and position during entire episode, then how the constitutional and human rights of an individual will remain safe in this anarchy.
Article 21 of Constitution of India: Protection of Life and Personal Liberty. Article 21 states that “No person shall be deprived of his life or personal liberty except according to a procedure established by law.” Thus, article 21 secures two rights: the Right to life, and. 2- Right to personal liberty.
Whether Right to Life can be ensured by depriving poor daily wage staff of 27 months salary Divisional Forest Officer Gorakhpur?
5- According to Article 5 of Universal Declaration of Human Rights- No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.
Whether protectors of Human Rights will tell the complainant that how the inhuman act of the tyrant like Divisional Forest Officer Gorakhpur is justified? Whether lacunae on the part of working of the public authority can deprive the victim of the 27 months salary?
6- According to Article 7 of Universal Declaration of Human Rights also the Article 14 of the constitution of India- All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.
Government of Uttar Pradesh specially the working of the divisional forest officer Gorakhpur and office of chief conservator Gorakhpur providing half of the minimum wages to its daily wage staff as prescribed by the government itself. Whether it is not violation of human rights of innocent and gullible people?
