Factual position is that applicant sought information regarding the order passed by SHRC, Uttar Pradesh Case Details Diary No 1894/IN/2021 Case / File No 2383/24/48/2021-WC Action Date 12/08/2021 Authority THE COMMISSIONER OF POLICE, LUCKNOW Proceeding याचिका की प्रतिलिपि पुलिस आयुक्त, लखनऊ को इस निर्देश के साथ भेज दी जाये कि वह प्रार्थी श्री योगी एम0पी0 सिंह द्वारा दिये गये शिकायती प्रार्थना पत्र में अंकित आरोपों की जांच राजपत्रित अधिकारी से करवा कर आवश्यक वैधानिक कार्यवाही सुनिश्चित करायें तथा कृत कार्यवाही की आख्या आयोग को दिनांक 03.09.2021 तक उपलब्ध करायेंपत्रावली दिनांक 06.09.2021 को पुनः प्रस्तुत हो

1-Provide the status  of the compliance regarding aforementioned order passed by the Honourable member of the Uttar Pradesh human rights commission. 

2-Provide the name and designation of gazetted officer appointed by the commissioner of police to comply to the order passed as aforementioned.

3-Provide the copy of the enquiry report submitted by the enquiry officer appointed by the police commissioner, Lucknow in compliance of the order of the commission. 

4-If commissioner of police Lucknow did not proceed in the matter still, then provide the cause of procrastination under subsection  1 d of section 4 of the Right to Information Act 2005. 

The information provided by them is surprising as no gazetted officer appointed by the commissioner of police to comply to the order passed as aforementioned.

Voluminous misleading information provided by the public information officer in the office of commissioner of police Lucknow, but it lacked detail of the gazetted officer in the compliance of order passed by the Honourable member of the commission. 

According to criminal penal code Chapter XII Section 173 deals with investigation of the police with section 161 and 164 as auxiliary provisions.

Description 1-Every investigation under this Chapter shall be completed without unnecessary delay.
