The matter is concerned with the illegal, unconstitutional, arbitrary extortion of fee from the poor guardians of students by the government of Uttar Pradesh through private management run English medium schools. The matter is concerned with the deep-rooted corruption and wide public interest. It can not be overlooked by the registrar judicial by taking the recourse that contents of the communication are not covered under public interest litigation guidelines.

 

 

An application under Article 32 of the constitution of India to seek justice for vulnerable citizenry in the state of Uttar Pradesh being looted by the government functionaries of the state through private management run English medium schools in the state also private management run B.Ed, B.T.C. now D.E.L.Ed, engineering colleges and medical colleges. There is complete loot of innocent and gullible citizenry in the state by the private management run school in caucus with the government functionaries. Genuine representations of the citizenry are disposed of by submitting arbitrary inconsistent reports. Law order machinery in the state is failed which can be easily guessed from the fact that order passed by the High court of judicature is superseded by the sub-inspector in the state. Everything is derailed in the state of Uttar Pradsh.

1-month of April 2020, 2-month of May 2020 3-month of June 2020 4-July 2020 5-August 2020 from the guardians of the students.

Hon’ble Sir may be pleased to pass an order to curb the exploitation of millions of the people in the state who are a sufferer in this period of coronavirus pandemic when the unemployment is on its zenith.

Most revered Sir –Your applicant invites the kind attention of Hon’ble Sir with due respect to the following submissions as follows.

1-It is submitted before the Hon’ble Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;

(i) to safeguard public property and to abjure violence;

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.

2-It is to be submitted before the Hon’ble Sir that Mahabharat is the great epic of this largest democracy in the world. Which is a story of civil war happened because of great grandfather Pitamah Bheeshm as his loyalty was only to the crown not to the country caused a terrible civil war which destroyed the entire human culture of that time so history is witnessed that instead of loyalty to the crown it must be shifted to the country otherwise only destruction and annihilation is invited. In this period of natural calamity, when the citizenry is deprived of livelihood whether such loot by the money-minting institutions can be allowed by the apex court of India which is the supreme guardian of the constitution?

No information is made available by D. M. Mirzapur even after the first appeal.

This institution made on the land of municipality Mirzapur city charges the greatest amount of fee from the guardians moreover it charges Rs.30000 as admission fee and this fee is justified by D.I.O.S. Mirzapur by an illogical remark that this admission fee is three years old and this amount is charged from the student one time.

Sir these money minting institutions are amassing huge wealth per year from the poor guardians by luring them in the name of English medium education. Government of Uttar Pradesh through its corrupt public functionaries not only promoting but extending the banned lease of public land which extension was banned by the Akhilesh Yadav Government. These things are taking place because of rampant corruption in the regime of the ongoing incumbent. Think about the gravity of the situation that no information is made available in the state of Uttar Pradesh because of rampant corruption in the state.

Following is the sought information from D. M. Mirzapur through the aforementioned registration number.

Since the year 2016, the matter of Lions school Laldiggi Mirzapur is being raised by the applicant as the lease of land with municipality Mirzapur city expired and extension is banned by the government. Please provide the following point-wise information.

1-Copy of entire documents exchanged between govt. and district administration.

2-Complaint number-60000200044584 on Jansunwai-Matter concerned with municipality Mirzapur city but forwarded to B.S.A. for redressal. Please provide the reason.

3-Extension of the lease is banned, provide a copy of the letter of govt. authorizing college new construction and use municipality land.

4-It is to be submitted before the Hon’ble Sir that Registration Number-DMOMR/R/2020/60011 submitted on Date of Filing-16/06/2020

1-Provide fee structure of the Lions School Laldiggi Mirzapur provided to you quite obvious from the communication number-1072 dated-15/06/2020 addressed to D.M. Mirzapur attached to communiqué.

2-Provide the total enrolled students in Lions school as the aforementioned class-wise previous year.

3-Provide the total new enrolled students additionally in each class in Lions school as aforementioned.

4-Provide the admission fee structure of each class in the Lions school likewise LKG and UKG as mentioned in communication number-1072 dated-15/06/2020.

Merely in the year 2017, Honourable commission imposed 709 pecuniary penalties and concerned district Magistrate was directed to recover the imposed penalties but the government of Bhartiya Janata Party did not recover the imposed penalties as it has no regard for the rule of law. Only those personnel are posted at the post of district magistrate who is incompetent for the post and blindly follows the dictates of local political masters without thinking the pros and cons.

Hon’ble Sir may consider on it that whether there is rule of law in the state of Uttar Pradesh if the orders passed by the constitutional functionaries are languishing before the government of Uttar Pradesh?

6-It is to be submitted before the Hon’ble Sir that how the rule of law in the state of Uttar Pradesh can be expected as it neither takes action against the wrongdoers itself and if premier investigation agency central bureau of investigation recommends action against staffs who found indulged in the corrupt practices, then the government of Uttar Pradesh instead of taking prompt action on these recommendations its accountable staffs only procrastinate on such recommendations.
