Why irritating messages are sent by the department of income tax arbitrarily to file income tax return even when individual and his family is on the verge of hunger?

An application under article 51 A of the constitution of India to curb flow of irritating messages to students, unemployed youths and poor citizens living under poverty by the department of income tax regarding filing of income tax return. 
Most revered Sir –Your applicant invites the kind attention of the Hon’ble Sir with due respect to the following submissions as follows. 

1-It is submitted before the Hon’ble Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform; 

(i) to safeguard public property and to abjure violence; 

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement. 

  2-It is submitted before the Hon’ble Sir that the following is explicit criteria setup by the government of India to serve the notices to seek income tax return. It is most unfortunate that the department of income tax because of rampant corruption of its staffs by sitting in their luxury offices used to send irritating messages to file income tax return to the innocent and gullible citizens on their mobile phones and emails. 

Mandatorily filing of income tax return
As per income tax laws, ITR must be mandatorily filed if a resident individual's total income during the financial year exceeds the basic exemption limit. Remember, the basic exemption limit for an individual depends on his/her age.

 For FY 2019-20, the basic exemption limit is as follows:

Age of an individual Below 60 years of age

Basic exemption limit (Rs)  2,50,000

Age of an individual Between 60 and 80 years of age (Senior citizen)

Basic exemption limit (Rs)  3,00,000

Age of an individual 80 years and above (Super Citizen)
Basic exemption limit (Rs)  5,00,000

When your gross total income does not exceed basic exemption limit

In certain cases, even if the gross total income does not exceed the exemption limits as mentioned above, you have to mandatorily file income tax return. As per current income tax law, income tax return for FY 2019-20 must be mandatorily filed before January 10, 2021, if:

a)Individual has spent an amount or aggregate of amounts exceeding Rs 2 lakh for himself/herself or any other person for travel to

b)Individual has deposited an amount or aggregate of amounts exceeding Rs 1 crore in one or more current accounts maintained with a bank or co-operative bank;
c)Individual has paid electricity bill exceeding Rs 1 lakh in a single bill or on aggregate basis during the financial year;
d)Ordinarily resident individual having income from foreign countries and/or assets in foreign countries and/or having signing authority in any account outside India; and
e)If an individual's gross total  income exceeds the exemption limit before claiming tax exemption on capital gains under section 54, 54B, 54D, 54EC, 54F, 54G, 54GA or 54GB

    3-It is submitted before the Hon’ble Sir that undoubtedly notice of the income tax has value but such streams of irritating messages are reflecting sheer lawlessness and anarchy originating from corruption. Only to sit in the office can not curb tax evasion and when public spirited individuals inform about tax evasion, then instead of taking any action only shields the wrongdoers. This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.

It is quite obvious that to send arbitrary messages to file income tax return to those who does not come under the purview of mandatory filing of income tax return is unconstitutional reflects rampant corruption in the department of income tax. Such practices must be stopped by the government of India. Government functionaries must ensure transparency and accountability.

It is request for the staff of the Income-Tax Government of India that they may come out in the field and check the properties of the public if they are entitled to pay the taxes then they must send the notices otherwise such arbitrary streams of notices what ever they are sending on the mobile phones and emails they must stop otherwise such arbitrary actions are only reflecting lawlessness and anarchy in the working of the department of income tax and we are already apprised with this fact that there is rampant corruption in the department of income tax and they do not take any action against the wrongdoer who are evading taxes.

  4. How the messages to the people who are not required mandatory to file income tax return can be justified? Such streams of messages are only sent to achieve the ultirior design so it must be stopped.
