An application under Article 51 A of the constitution of India to seek action against the growing practice of allocating constitutional posts to incompetent people by taking bribe.

  To
Hon'ble chief justice of India/ companion judges
Supreme Court of India, New Delhi
Prayer-Please direct the government of India to frame a transparent and accountable mechanism regarding the appointment and posting of constitutional posts.
Cause of action-1-Concerned government functionaries seek bribe to appoint a candidate for a constitutional post.
2-They appoint ineligible candidates for the constitutional posts as the highest bidder among the claimants to occupy the constitutional post.
3-Since the appointment is based on corruption, so these constitutional functionaries only promote corruption in the government and never perform the business impartially.
4-Now a day our maximum constitutional posts are flooded with the incompetent corrupt staffs who only promotes anarchy in the government.
5-No public functionary few exceptions in this largest democracy in the world promotes honesty, and they run away from entertaining the matter concerned with the serious allegations of the corruption.
6-Those raising voices against growing corruption, subjects of physical and mental torture by wrongdoer staffs of the government.
7-Corruption always creates corruption, not honesty and appointment of supervisory bodies through corruption can never be instrumental in good governance.
Shooter Vartika Singh Goes To Court Against Smriti Irani, 2 Others

Vartika Singh alleged that people close to the minister issued her a fake letter, appointing her as a member of the central women's commission, a possible reference to the National Commission for Women.

The MP-MLA court has fixed January 2 for a hearing, after which it will decide if the case falls under its jurisdiction, according to her lawyer.

The shooter alleged that people close to the minister issued her a fake letter, appointing her as a member of the central women's commission, a possible reference to the National Commission for Women.

She alleged that Vijay Gupta and Rajnish Singh, the two "aides" of the Union minister, initially demanded ₹ 1 crore from her and then brought the amount down to ₹ 25 lakh.

She also alleged that one of the men talked to her in an obscene manner.

Sir, here police lodged F.I.R. against Vartika Singh because she exposed the corrupt sheep in the government machinery but her representations before the judiciary of this country is pending for deciding jurisdiction of the court.

On November 23, however, Vijay Gupta had lodged a complaint against the shooter and another person at Musafirkhana police station in Amethi district, accusing them of levelling unfounded charges against him and trying to spoil his image.

Based on the complaint, police had lodged an FIR against her.

Vartika Singh, however, claimed that the complaint was lodged after she threatened to expose "corruption".

Whether the F.I.R. LODGED against Shooter Vartika Singh, apex court can justify?

Whether this fabricated F.I.R. is not an attempt to suppress the raised voice against corruption?

This is a humble request of your applicant to you Hon’ble Sir that how can anyone justify to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.

Date-26/12/2020            Yours sincerely

Case filed by Smriti Irani’s aide: Sultanpur court sends dental surgeon to judicial custody

Express News Service  11 hours ago

A local court in Sultanpur on Friday sent to judicial custody an accused whose name cropped up during the police investigation in a case filed by an aide of Union minister Smriti Irani.

The police said that on November 23, 2020, Irani’s aide Vijay Gupta filed a complaint against international shooter Vartika Singh and former Congress MP Kamal Kishore Commando at the Musafirkhana police station in Amethi after they accused him of demanding Rs 25 lakh to make Singh a member of the women’s commission.

Defence counsel Ravi Bansh Singh said Vartika Singh then filed a plea seeking a direction to the police to file an FIR against Smriti Irani, Gupta and Dr Rajnish Kumar, a dental surgeon, on the charge of demanding money from her. But the petition was rejected.

During its investigation into Gupta’s complaint, the police came across the alleged role of Dr Rajnish Kumar. The surgeon was declared a proclaimed offender by the court after he remained absconding, said police. On Friday, the 30-year-old appeared before the local court that sent him to judicial custody, said inspector Parshu Ram Ojha, the investigating officer in the case.

Ojha said so far, the role of Kamal Kishor had not been established.

Lawyer Ravi Bansh Singh said the police had filed a chargesheet against Vartika Singh based on Gupta’s complaint. The case, which is being heard in the MP-MLA court of Sultanpur, will be next heard on Saturday.

The case was initially filed under IPC section 509 (word, gesture or act intended to insult the modesty of a woman) and different sections of the IT Act. During the investigation, other IPC sections, including 419 (cheating by personation), 420 (cheating and dishonestly inducing delivery of property), 467 (forgery of valuable security, will, etc), and 468 (forgery for purpose of cheating) were added.

If the justice is available to vulnerable section, then this matter might have moved in constructive direction but what happened? Every one knows.

  2. If someone setting the mouth of whistleblower shutdown it is unjustified. Here the role of the police remained partial and biased and more supportive to the influential people and police pressurized the victim and court remained mute spectator throughout the entire episode which is showing that our constitutional rights are no more safe in this anarchy where lawlessness and chaos are quite rampant in our government machinery..

  3. Our government does not take action against the influential people which is quite obvious from the rampant corruption in the government machinery so one must not seek action against the influential people because all efforts will go in vain.
